St. Louis, Missouri (January 2014) -- In the Cleveland mesothelioma case No. CV-12-789009, Panza vs. Kelsey-Hayes Company, John Panza obtained a settlement of $27.5 million. The law firm of Waters & Kraus, LLP served as council for John Panza, a 40 year old college professor who went through an extra pleural pneumonectomy (EPP). The lawsuit alleged that his exposure was from his father who was a bystander at a facility that worked on friction materials and brought home fibers on his clothes. The Court of Common Pleas, Cuyahoga County, Ohio approved a settlement in favor of John Panza in December 2013.

“This was a true victory for both the plaintive, John Panza, and affected families like John’s that were allegedly exposed to asbestos which resulted in mesothelioma cancer years later,” said Neil Maune, partner at MRHFM.

Panza alleged secondary exposure in his lawsuit meaning that he was not directly in the environment where there was asbestos. Like many, the secondary exposure came into the home from work clothes of an employee, in this case allegedly John’s father. The allegation that John Panza was a bystander is significant in this case as he was not the one directly exposed to asbestos, but ended up with mesothelioma cancer without being directly exposed to asbestos like his father.
